Subject-matter expert witness services are the core of Rick Bingham and GIC's practice.

Mr. Bingham's credentials as a subject matter expert have been accepted in both state and federal legal jurisdictions. His reputation for trustworthiness is displayed by the confidence reposed in him by the Attorney Registration and Disciplinary Commission where, for 14 years, he served as a hearing officer and adjudicated the most serious cases of attorney malfeasance.

We relish the challenge of explaining the issues and their applicability to the conduct of the parties, and their consistency with — or deviation from — the standard of conduct or practice for complex insurance problems.

We begin with a thorough examination of the record using the most powerful case management software and tools. We combine this with our unique experience to develop our initial proto-opinions. Supportive and contradictory facts are flagged in the record. We complete our work by writing thorough, accurate and well-cited reports. Mr. Bingham is keen to summarize and report our findings in depositions and at trial.

Representative Engagements

The following are representative samples of GIC's engagements as a subject matter expert. Glynloen Insurance Consulting has been retained by:

• A Department of Financial Services as an expert to review the claims practices of an insurance entity in Receivership, in a case for damages against the Directors and Officers of the insurer as well as their outside auditor. This required analysis of corporate governance, claim reserving, communication with claimants, and adherence to fair claims practice rules and file documentation standards.
• A Third-Party Claims Administrator in a Federal action alleging breach of contract and incompetent claim handling. Relying upon the extensive work of GIC, the client was able to rid themselves of the case by dispositive motion.
• A cedent in litigation with a facultative reinsurer concerning the claim cessions of a tier-3 asbestos policyholder. Mr. Bingham and his team reviewed a record of over 40,000 pages and authored a 70-page report in less than five weeks, addressing late notice, proper reserving, and the rights of inspection and participation of the facultative reinsurer. He also authored an 80-page rebuttal report and gave testimony via deposition.
• A primary carrier sued by an excess carrier for equitable subrogation for bad faith and allegations of statutory bad faith. Mr. Bingham authored a 94-page report with 445 citations and a 57-page rebuttal report with 142 citations disputing the allegations.
• A law firm sued by an excess carrier for negligence in the defense of an insurance action, where the excess carrier alleged that the defense of a maritime claim was flawed, that the lawyer inadequately prepared the case for trial, and that counsel was responsible for providing late notice to the excess carrier.

Mr. Bingham has also been engaged and has testified or reported upon the relevancy of fair claims practices rules and regulations in Alabama, Arizona, Florida, Illinois, California, South Carolina and Pennsylvania.
